Booking conditions of Hotel Sol Ixent

GENERAL CONTRACTUAL CONDITIONS

1. OBJECT

The purpose of this document is to regulate the GENERAL TERMS OR CONDITIONS OF CONTRACT between CADAQUÉS SOL, SL with CIF B17869843 and registered office in Cadaqués (Girona), Passeig del mar street number 2 (hereinafter THE COMPANY) and the users who manage their online reservations through the website www.hotelsolixent.com.

These General Terms and Conditions have been drawn up in accordance with the provisions of Law 34/2002, on information society services and electronic commerce, Royal Legislative Decree 1/2007 on the Defense of Consumers and Users and any other applicable legal provisions.

Making an online reservation implies acceptance, as a User, of these General Terms and Conditions of Contract, which will be considered automatically incorporated into the contract signed with CADAQUÉS SOL, SL without the need for written transcription in the same.

The COMPANY informs that the procedures for making online reservations are those described in these general conditions, as well as any other specific procedures indicated on the screen during navigation, so that the User declares to know and accept these procedures as necessary to obtain a reservation at our hotel.


2. PROCUREMENT PROCEDURE

The user must select their check-in and check-out dates on the calendar to check room availability and prices. Prices shown are in Euros and include Value Added Tax (VAT).

Once the room or promotional package offered has been selected, users must complete their details in the form provided and then make the payment for the reservation via bank card or the PAYPAL payment platform.

Once payment has been made, CADAQUÉS SOL, SL will send you an email confirming your booking details.


3. ACCEPTANCE

Both parties accept this document, which means that the user:

a) He/She has read, understands and comprehends all of its clauses

b) He/She is a person of legal age with full capacity to enter into contracts and obligations

c) Assumes each and every one of the obligations set forth therein

d) You have read and accept these general terms and conditions of purchase

The hotel's confirmation of the reservation is understood as the conclusion of a binding purchase agreement.

In compliance with the provisions of Law 34/2002 on Information Society Services and Electronic Commerce, the company informs you that this electronic contract will not be stored by third parties.


4. CANCELLATION CONDITIONS

The credit card is only a means of guarantee. Cancellation of reservations will not incur any early cancellation fees for the user, provided that the cancellation is requested at least 48 hours before the scheduled check-in date and time (maximum until 3:00 PM).

If the cancellation is made within 48 hours of the arrival date, CADAQUÉS SOL will charge the client's credit card the cost of the first night as compensation. This clause does not apply to reservations made with special rates, which require a non-refundable deposit of 100% of the total reservation cost. In this case, no changes or refunds will be permitted.

In the event that the client does not show up at the hotel without prior notice, CADAQUÉS SOL will charge the client's card 100% of the total cost of the reserved stay. (VAT and taxes included).

Leaving the room before the date specified in the reservation will incur a charge of 50% of the amount of the services remaining to be used.


5. PRICES PER ROOM AND NIGHT

Prices are only valid in writing and for the period indicated. When justifiable reasons exist, CADAQUÉS SOL reserves the right to modify these rates without prior notice.

Prices for your reservation will be shown during the booking process and will include VAT at the applicable rate at the time of booking. However, additional taxes (including tourist tax) must be paid directly to the hotel. The tourist tax is 0.90€ per person per day, but it will not apply from the seventh consecutive night of your stay onwards, nor to children up to 16 years old.

Hotel Sol Ixent reserves the right to correct any discrepancies that may arise when the system calculates the rate. In this case, the hotel will notify the customer of the correct rate as soon as possible. The customer may accept the change or cancel the reservation free of charge.

Pets are not allowed in our establishment.

Check-in is from 3 pm and check-out is between 8 am and 12 pm.

The user agrees to use the services in accordance with the law, morality, good customs, and public order, as well as with the provisions of these terms and/or general conditions of service. Consequently, the user is obligated not to use the services for illicit purposes or effects, or in any way contrary to these terms, or in any way that may infringe upon the rights and/or interests of third parties, or that may damage the services, the company, or its corporate image.


6. PROPER USE OF WEBSITE CONTENT BY THE USER

CADAQUÉS SOL, SL. declares that the industrial property rights (trademarks, trade names, etc.) appearing on this website are its property and/or are legitimately used under agreements or licenses, and are duly protected by existing industrial property regulations. The user agrees to use the website diligently, correctly, and lawfully, and in particular, undertakes to refrain from:

a) To suppress, circumvent or manipulate the “copyright”, trademarks and other identifying data of the rights of CADAQUÉS SOL, SL. or of its owners incorporated into the content and/or products marketed from its Website, as well as the technical protection devices, digital fingerprints or any information mechanisms that they may contain.

b) To use the content and, in particular, the information of CADAQUÉS SOL, SL obtained through its Website to send advertising, communications for direct sales purposes or for any other kind of commercial purpose, unsolicited messages addressed to a plurality of people.

c) Reproducing or copying, distributing, allowing public access through any means of public communication, transforming or modifying the contents, unless authorized by the holder of the corresponding rights or legally permitted.

d) In general, using the content in a manner, for purposes, or with effects contrary to the law, morality, generally accepted good customs, or public order. CADAQUÉS SOL, SL does not grant any license or authorization of use of any kind regarding its industrial and intellectual property rights or any other property or right related to its Website.

If any User or a third party believes that any of the content entered on the Website violates any of their intellectual property rights, they must send a notification to CADAQUÉS SOL, SL. with a complete and accurate indication of their details, the allegedly infringed intellectual property rights and their Website.

CADAQUÉS SOL, SL may, for greater efficiency and for the benefit of users, unilaterally modify, at any time and without prior notice, the services provided, or the operating, technical and usage conditions of the services.


7. PROTECTION OF USERS' PERSONAL DATA BY CADAQUÉS SOL, SL

In compliance with the provisions of the Organic Law on the Protection of Personal Data, the European Union Regulation 679/2016 (GDPR) and its implementing regulations, this clause informs you that the personal data you provide to CADAQUÉS SOL, SL under the current proposal/contract, as well as those you provide in the future, will be incorporated into a file owned by the latter.

The purpose of processing your data will be the maintenance, development, control and execution of the contractual relationship that, within the framework of the provision of the services identified in the object of the contract, you maintain with CADAQUÉS SOL, SL

Your data will not be transferred or communicated to third parties, except as required by law, and will be kept as long as you do not request its cancellation.

At any time you may exercise your rights of access, rectification, portability, opposition and, where appropriate, limitation and cancellation, by sending a written communication and indicating your personal data to the address Passeig del mar, number 2 of Cadaqués (Girona) or by email to info@hotelsolixent.com.

In accordance with current legislation on the Protection of Personal Data, CADAQUÉS SOL, SL undertakes to maintain the strictest confidentiality regarding the information and/or documentation to which it has access, and may only use it for the purposes stipulated in the current contractual relationship. It may not disclose or make known to third parties the aforementioned information without your prior consent.

CADAQUÉS SOL, SL is responsible for having implemented the appropriate security measures, in accordance with the provisions of the Data Protection regulations.

Furthermore, it undertakes to have documented and implemented both the Security Document and the legally corresponding security procedures.

All staff at CADAQUÉS SOL, SL will be aware of the regulations regarding the LOPD (Spanish Data Protection Law) when they process customer information.

Users of www.hotelsolixent.com guarantee and are responsible, in any case, for the truthfulness, accuracy, validity and authenticity of the personal data provided and undertake to keep them duly updated.

The services of CADAQUÉS SOL, SL are not intended for minors, therefore no information relating to minors is requested or collected.

Once the contractual service has been completed, the personal data and the electronic document in which the reservation is formalized will be archived and kept, properly blocked, for the legally established period.

User account data inquiries and requests for services or products through the website www.hotelsolixent.com are conducted via a secure server. The server software encrypts the information entered by the user before transmitting it to the company. Furthermore, CADAQUÉS SOL, SL has strict security procedures in place regarding data storage and disclosure to prevent any unauthorized access.


8. EXCLUSION OF WARRANTIES AND LIABILITY

CADAQUÉS SOL, SL does not guarantee the reliability, availability or continuity of the services made available to the user, therefore it excludes any liability for damages and/or losses that may be due to the lack of availability, reliability or continuity of its website or its services, although it will try to provide, to the extent possible, technical assistance to the affected person, making available, to the extent possible, alternative means.

CADAQUÉS SOL, SL is not obliged to control and does not control in advance the absence of viruses or elements in the content that may cause alterations in the software or hardware of users or people who visit the pages, and therefore will not be liable for damages of any kind that may arise from them.

If CADAQUÉS SOL, SL, despite acting with due diligence and foresight, is unable to provide the booked rooms for reasons beyond its control and it is materially impossible for it to provide the services under the agreed conditions, CADAQUÉS SOL, SL will offer the user the option of a full refund or a replacement with another service of similar category or quality. If, as a result of the replacement, the service is of a lower category or quality, CADAQUÉS SOL, SL must refund the difference.


9. NULLITY AND INEFFECTIVENESS OF CLAUSES

If any of the clauses included in these General Conditions is declared, in whole or in part, null or ineffective, it will only affect that provision or part of them that is null or ineffective, with the rest of the General Conditions remaining in force, with such provision or the part of it that is affected being considered as not included.


10. APPLICABLE LAW AND JURISDICTION

These general terms and conditions shall be governed by and construed in accordance with Spanish law, with particular attention to the regulations on Information Society Services and Electronic Commerce, set out in Law 34/2002 of 11 July, and the regulations governing general terms and conditions of contracts by electronic means, set out in Royal Decree 1906/1999 of 17 December and Law 7/1998 of 13 April. The parties submit, at their option, to the courts of the company's registered office for the resolution of any disputes, expressly waiving any other jurisdiction.
