GENERAL CONDITIONS OF THE CONTRACT
1. OBJECT
The purpose of this document is to regulate the GENERAL CONDITIONS OF CONTRACT between CADAQUÉS SOL, SL with CIF B17869843 and the registered office in Cadaqués (Girona), calle Passeig del mar number 2 (hereinafter THE COMPANY) and the users who manage your on-line reservations via the web www.hotelsolixent.com.
These general conditions have been prepared in accordance with the provisions of Law 34/2002 on Services of the Information Society and Electronic Commerce, Royal Legislative Decree 1/2007 on the Defense of Consumers and Users and the number of applicable legal provisions.
The formalization of an online reservation implies the acceptance, as a user, of these general conditions of sale, which will be considered as automatically incorporated in the contract signed with CADAQUÉS SOL, SL without the need to transcribe by written the same.
The COMPANY informs that the online reservation procedures are those described in these general conditions, as well as those specific which are indicated on the screen during navigation, so that the User declares to know and accept the said procedures necessary to obtain a reservation at our hotel.
2. CONTRACT PROCEDURE
The user must mark the arrival and departure dates on the calendar in order to verify the availability of rooms and their prices. The prices indicated are in euros and include value added tax (VAT).
Once the room or the proposed promotional package has been selected, users must enter their data in the form provided to subsequently pay for the reservation by credit card.
CADAQUÉS SOL, SL once payment has been made, will send you an email confirming the details of your reservation.
3. ACCEPTANCE
Both parties agree to this document, which means that the user:
a) Has read, understood and understood all of its clauses
b) Is an adult with full capacity to contract and be bound
c) assume each of the obligations set out therein
d) You have read and accepted these general conditions of purchase
The confirmation of the reservation by the hotel is understood as the conclusion of a binding sales contract.
In accordance with the provisions of Law 34/2002 on Services of the Information Society and Electronic Commerce, the company informs you that this electronic contract will not be kept by third parties.
4. TERMS OF CANCELATION
The credit card is only a means of guarantee. Cancellation of reservations will not result in an early cancellation fee for the user, provided that the cancellation is requested at least 48 hours before the day and time set for entry into the hotel (maximum until 3:00 p.m.).
If the cancellation is made within 48 hours before the day of arrival, CADAQUÉS SOL will debit the customer's credit card, as compensation, for the cost of the first night. This clause is not valid for reservations made with special rates which will require a non-refundable deposit of 100% of the total reservation. In this case, no modification or refund will be accepted.
In the event that the client, without prior notice, does not appear at the hotel, CADAQUÉS SOL will debit the client's card at 100% of the total amount of the reserved stay. (VAT and taxes included).
Leaving the room before the date provided in the reservation has a cost of 50% of the amount of the services that remain to be used.
5. PRICE PER ROOM AND NIGHT
The prices are only valid in writing and during the period indicated therein. When there are justifiable reasons, CADAQUÉS SOL reserves the right to modify these prices without notice.
The prices relating to the reservation will be indicated to you during the reservation process and will include VAT according to the tax rate in force at the time. However, additional taxes (tourist tax among others) must be paid directly to the hotel. The tourist tax is 0.66€ per person per day, but it will not be applied from the seventh consecutive night of the stay, nor to children up to 16 years old.
Hotel Sol Ixent reserves the right to correct any discrepancy that may arise when calculating the rate by the system. In this case, the hotel will inform the client as soon as possible of the correct rate. The customer can accept the change or cancel the reservation at no cost.
Animals are not allowed in our establishment.
Children from 11 years of age are allowed to stay overnight.
Breakfast is included in the price of the room.
Entrance to the room is from 3 p.m. and exit between 8 and 12 a.m.
The user undertakes to use the services in a manner that complies with the law, good morals, good morals and public order, as well as the provisions of these general conditions and / or contractual conditions. Consequently, you are obliged not to use the services, for purposes or effects that are illegal and / or contrary to what is established in these conditions, detrimental to the rights and / or interests of third parties or which, in any way whatsoever either, could damage the services. , the company or its corporate image.
6. CORRECT USE OF THE CONTENT OF THE WEBSITE BY THE USER
CADAQUÉS SOL, SL. declares that the industrial property rights (trademarks, trade names, etc.) that appear on this website are its property and / or are legitimately exploited under agreements or user licenses, duly protected by the regulations in force on industrial property. The User undertakes to use the Website in a diligent, correct and lawful manner and, in particular, undertakes to refrain from:

8. EXCLUSION OF GUARANTEES AND RESPONSIBILITIES
CADAQUÉS SOL, SL does not guarantee the reliability, availability or continuity of the services made available to the user, therefore, it excludes all liability for damages and / or losses that may be due to lack of availability, reliability or continuity of its website or services, although it will endeavor to provide, to the extent of its possibilities, technical assistance to the affected person, making available to them alternative means, to the extent of its possibilities.
CADAQUÉS SOL, SL is not obliged to control and does not control in advance, the absence of viruses or elements in the content, which may lead to alterations in the software or hardware of users or of those who visit the pages, so that it will not be liable for any damages of any kind that may result from it.
If CADAQUÉS SOL, SL, despite having acted with foresight and reasonable diligence, could not provide the rooms contracted for reasons that are not attributable to it and that it is materially impossible to provide the services under the agreed conditions, CADAQUÉS SOL, SL will offer the user the possibility of opting for a full refund of the amount paid or for its replacement by another service with similar characteristics in terms of category or quality. If, due to the substitution, the service turns out to be of an inferior category or quality, CADAQUÉS SOL, SL must reimburse the difference.
9. NULLITY AND INEFFICIENCY OF THE CLAUSES
If one of the clauses included in these General Conditions was declared, totally or partially, null or inoperative, it will only affect the provision or the part of these which is null or inoperative, the rest of the General Conditions remaining, having such a layout or the part of the same that is affected by not putting.
10. APPLICABLE LAW AND JURISDICTION
These general conditions will be governed and interpreted in accordance with Spanish legislation, with particular attention to the regulations on services of the information society and electronic commerce, contained in Law 34/2002, of July 11, to regulatory regulations general conditions of electronic procurement, collected in DR 1906/1999 of December 17 and Law 7/1998 of April 13. The parties submit, at their option, for the resolution of disputes and waiver of any other jurisdiction, to the courts and tribunals of the domicile of the company.
